Terms & Conditions
These are the general website and service terms for Mash Creatives. Project-specific quotations, proposals, invoices or agreements may contain additional terms.
1. Acceptance of these terms
These Terms & Conditions apply to use of the Mash Creatives website and provide general conditions for enquiries and services. By using this website, you agree to these terms. Specific quotations, proposals, invoices, contracts or written project terms may contain additional or different conditions; where they conflict with these general website terms, the specific written project terms will apply to that project.
2. Website information
We aim to keep the information on this website accurate and useful, but website content is provided for general information and may be changed without notice. Service descriptions, examples, timelines and project information on the website do not by themselves create a binding quotation or guarantee of availability.
3. Quotes, scope and payments
Project scope, pricing, payment stages, timelines and deliverables are confirmed in the applicable quotation, proposal, invoice or agreement. Work outside the agreed scope may require an additional quotation or written approval.
A project may be paused where required information, approvals or agreed payments are outstanding.
4. Client responsibilities
Clients are responsible for providing accurate instructions, approvals, content, brand assets and access reasonably required for a project. Clients must have the necessary rights or permission to use any text, images, logos, trademarks, media or other materials they provide to Mash Creatives.
5. Intellectual property
Mash Creatives retains ownership of its pre-existing tools, methods, reusable code, know-how, templates and internal working materials. Ownership or licence rights in final project deliverables are governed by the specific project agreement or quotation and any applicable payment conditions.
Third-party software, plugins, themes, fonts, stock assets, platforms and services remain subject to their own licence terms.
6. Third-party services
Projects may rely on third-party services such as domain registrars, hosting providers, payment gateways, analytics platforms, social networks or other software. Mash Creatives does not control those providers and cannot guarantee their uninterrupted availability, pricing, policies or future functionality.
7. Portfolio and project references
Unless a project agreement states otherwise, Mash Creatives may identify completed work as part of its portfolio or case studies using material that is already public. Confidential information will not knowingly be published as portfolio material.
8. Prohibited use of the website
You may not misuse this website, attempt unauthorised access, interfere with its operation, introduce malicious code, scrape or copy substantial parts of the site in violation of applicable law, or use the website to infringe the rights of others.
9. Limitation of liability
To the extent permitted by law, Mash Creatives is not liable for indirect, incidental or consequential loss arising solely from use of this website, reliance on general website information, or failure of third-party services outside our reasonable control. Nothing in these terms excludes liability that cannot lawfully be excluded.
10. Governing law and contact
These website terms are governed by the laws of the Republic of South Africa. Questions about these terms may be sent to Info@mashcreatives.co.za.
